2020 Delhi riots: Court pulls up police for clubbing 39 complaints in 2 FIRs based on hearsay evidence
A Delhi court on Friday pulled up the Delhi Police for fallaciously clubbing 39 complaints together in the two First Information Reports (FIRs) against three people accused of rioting and unlawful assembly during the 2020 Delhi riots.
Additional Sessions Judge Pulastya Pramachala noted that the ‘hearsay evidence’ provided by the statements of the additional complainants cannot be considered as relevant evidence to establish the date and time of the incidents and ordered the Station House Officer to conduct a separate probe into the additional complaints.
“The additional complaints were not completely investigated to even confirm the date and time of such incidents, on the basis of relevant evidence. IO (investigating officer) simply relied upon the hearsay evidence of the additional complainants and clubbed these complaints in this case,” judge Pramachala observed. Read more
